Terms and Policies

If Beaux Box delivers a gift basket with a service guarantee after the applicable guaranteed delivery time on the applicable guaranteed delivery day, Beaux Box will, upon request by the gift sender, issue the gift sender a refund or credit (at Beaux Box’s option) in respect of the delivery.

In the event that a gift box covered by a service guarantee is not delivered in accordance with the applicable service guarantee, Beaux Box will, at its option, refund or credit a gift sender, upon request, an amount equal to the difference between (a) the delivery fees paid by the gift sender and (b) the delivery fees that would apply to the delivery service that was actually received.

If Beaux Box cannot deliver a gift box with a service guarantee on the applicable guaranteed delivery day, delivery will take place by end of day on the business day specified by Beaux Box.

The following limitations apply to guaranteed deliveries:

  • The delay must not be caused by some event beyond Beaux Box’s control, including but not limited to, those items described in “Liability of Beaux Box – events beyond Beaux Box’s Control”.
  • The delivery must not be left in a “Drop Box” after the posted pickup time; must not require pickup after local cut-off times; and must not be tendered to Beaux Box after local cut-off times.
  • The service guarantee may be suspended, modified or revoked at Beaux Box’s sole discretion.
  • The service guarantee will not apply to the following deliveries:
    • Deliveries originating from or destined to points deemed by Beaux Box to be remote, where such points are not serviced directly by Beaux Box couriers
    • Undeliverable or returned deliveries

Refunds

To obtain a refund or credit where applicable in accordance with Beaux Box’s service guarantee(s), customers should call the telephone number on their invoice or contact us at contact@beauxbox.ca and be ready to provide their order number. Beaux Box must receive a request for refund or credit in respect of a delivery to which a delivery service guarantee applies within 7 calendar days after the order was delivered or scheduled to be delivered.

Beaux Box reserves the right, at its sole discretion, to refuse a request for a refund or credit of delivery charges for any delivery, when such request is made by any party other than the payer of the delivery charges.

In the event that a gift box is undeliverable, the delivery shall be returned to the Beaux Box and shall be subject to all applicable charges.

For deliveries that cannot be delivered or returned for any reason, title to the delivery(s) will pass to Beaux Box and such delivery(s) may be disposed of in Beaux Box’s sole discretion and at any location:
(i) in the case of deliveries consisting of general articles, where such articles have been in Beaux Box’s possession for 10 days or more.
(ii) in the case of deliveries consisting of perishable articles, where such articles have been in Beaux Box’s possession for 5 days or more.

For deliveries to Greater Toronto Area and suburbs – If no one is at home when our drivers attempt delivery, our drivers will call the gift box recipient to see where they can safely leave the gift box.  If the driver cannot reach the box recipient, they will leave a message (if possible) and the driver will leave the box at a safe place without obtaining a signature.  If the box cannot be left safely and no one can accept the delivery, re-delivery will be necessary.  A re-delivery charge may be required at an additional charge (typically $20). We will try to avoid the re-delivery but we will not leave a box in an unsafe place.  We will arrange the re-delivery at the earliest possible time – often later in the day or the next day.  If you have paid for your order by PayPal, we will not do the re-delivery until we have received the re-delivery fees.

For Deliveries Outside of the Toronto Area – For shipments by common carrier, the courier will not attempt to contact the box recipient if no one is at home when the gift box arrives. Common carriers never call box recipients. Instead they will leave the package at the front door if they feel it is safe to do so.  If they do not feel it is safe to leave it at the front door, they will leave a notice indicating where the gift box can be picked up by the box recipient (e.g. at the post office or a Purolator Drop Box).  If the gift box is not picked up in the following 10 days, it will be returned to Beaux Box. Redelivery may be attempted. A re-delivery charge may be required at an additional charge (typically $15-$40).

Beaux Box will not process any claim for loss of or damage for any delivery unless notice thereof setting out the particulars of the origin, destination, date of delivery and the estimated amount claimed in respect of such loss or damage is given to Beaux Box in writing (by email to contact@beauxbox.ca or by website) within the time limits set out below, failing that Beaux Box will have no liability in respect of the delivery.

Beaux Box may also require supporting documentation in order to assess a claim. Such documentation may include pictures of the damages, estimates for repair, or other records. Failure to submit the necessary supporting documentation (in Beaux Box’s sole discretion) may result in the claim being denied.

The right to damages of any kind against Beaux Box will be extinguished unless Beaux Box is contacted within 5 calendar days of the damage package being received or 5 days from the date on which the delivery should have been delivered, or from the date on which delivery stopped.

Excluding refund requests made in respect of Beaux Box’s service guarantees, all claims must be submitted in writing by email to contact@beauxbox.ca or from our website with supporting documentation.

DAMAGE INSPECTIONS

Beaux Box retains the right to inspect any delivery that is the subject of a damage claim. If, at the time the damage claim is submitted, Beaux Box requests that the customer retain the delivery and packaging for inspection, the customer shall retain the delivery and packaging for inspection by Beaux Box for a period of 5 days. Failure to retain the delivery and packaging for inspection may result in the claim being denied.

Beaux Box reserves the right to discontinue, apply new, or modify existing, administrative charges at any time and from time to time. Unless otherwise indicated, any of the following administrative charges may be applied to any orders placed with Beaux Box.

You may incur additional charges when…

  • The receiver’s address is incorrect, incomplete or illegible.
  • The customer requests proof, and is provided with, a hard copy proof of delivery.

We ship to the United States regularly but warn that shipping costs can be much higher than domestically.

We ship most US orders via Purolator, USPS, CANPAR or FEDEX in 2-9 business days using ground services. Orders to the US will arrive in 3-9 days in most major metropolitan areas. Orders are shipped Monday-Friday; weekend and holiday deliveries are excluded. Please contact us for details.

Alaska & Hawaii

Most items shipped to AK and HI are delivered via Purolator, USPS or FEDEX. Please call (647) 478-7325 for details.

We ship all over the world! However, the costs can be very high.  If you would like to ship to a country other than Canada or the United States, give us a call and we will give you a cost estimate!

DELAY

Upon request, Beaux Box will, at its option, refund or credit a customer (payer) if a guaranteed delivery is not delivered in accordance with the applicable service guarantee (see “Service Guarantees”), but reserve that we are not obligated to do so.

LOSS OR DAMAGE TO DELIVERIES

See the above section titled “Missed Deliveries and Undeliverable Packages” for more information.

From time to time, substitutions may be necessary to fill an order in a timely manner. Some of the items in our Gift Boxes may be backordered, discontinued or out-of-stock for a variety of reasons — most of which are beyond our control.

In these circumstances, we will substitute items of equal or greater value in all cases.  We reserve the right to substitute any item with an item of equal or greater value. Doing this, will ensure that your order will be delivered on a timely basis.

Please understand that the utmost care and attention is given to your order to ensure that it is as similar as possible to the one requested.

Our Service Area

The reason for Beaux Box Special Delivery only operating within Toronto is a good one; we deliver all orders ourselves using an electronically powered (green) bike! For this reason, we can’t ask our couriers to travel outside of the city limits – they’d probably get lost!

If you need an order shipped elsewhere, please don’t hesitate to contact us.
